The Collapse of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the tension sparked by the introduction of a new 28-article proposal for ending the war appeared – temporarily – to have been contained. A senior US official spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its countermove: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Peace Talks and Military Action

The chain of conflicting incidents captured the harsh reality of the recent timeframe. By day, diplomatic battles are conducted: positive announcements are issued from multiple capitals. Considerable effort is expended on containing specific proposals. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "settlement".

After-Dark Attacks

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is able to track projectile deployments from enemy soil, a capability afforded by current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to engage hostile guided weapons flew past – modern combat jets provided to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons thundered: defensive missiles targeted at a incoming threat. This was a sophisticated defense system at work, probably supplied through partner states. Every launch shakes the surroundings, causing tremors. The instant of fear quickly gives way to grim resignation: maybe the approaching threat won't cause damage this time, sparing the city from catastrophe and another blackout.

Persistent Threats

Soon after, a large-caliber weapon fired at a drone somewhere nearby, part of a mobile-fire group – almost certainly Western-made equipment. Unfortunately, the shots failed to hit the hostile drone – it pressed on overhead toward its objective.

Periodically, this continued until dawn. Kyiv faced the early updates: several casualties, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still maintained normal activities – experiencing conflict. But those full day illustrated Ukraine's vital need on international aid – a need that regional partners are evidently unprepared to fill in the short term.

Unsuccessful Negotiations

The 28-point plan from US administration sparked intense emotion, discussion and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new approach from American administration unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually win the battle. This trend will, certainly, endure.

Political Considerations

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the entire situation. American leadership functions according to a premise familiar among seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The White House presumes that it is impossible to force Russia to surrender the territory that it presently holds in Ukraine's south or east.

The issue is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through statements or actions, from thinking that the status quo will not evolve additionally in its advantage in the coming year.

Opposing Positions

Therefore, Moscow is certain that the clock favors them – that Ukraine and its supporters are nearing depletion. Their motivation to sign a deal that does not give them the maximum possible gain is close to zero. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still hold out, gradually sacrificing people and territory but averting a entire defensive failure until situations evolve in its advantage.

Existing Situation

Realistically, there are no real preconditions for a armistice. Now, individual motivations are becoming relevant: personal goals to negotiate peace and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any plan Kyiv finds unacceptable, so that their priority does not switch to homefront challenges. And although their objective will now be significantly challenging after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a just a single week to terminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the other European countries, along with calming attempts of representatives, and finally, recent disclosures, all served their function.

While new plans based on established approaches are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and show certain reluctance to change the course of events, if they remain united and enhance their military capacity at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, primarily depend on ongoing international assistance.
